A public records act request has revealed that black and latino riders are disproportionately likely to be cited for eating and drinking violations on BART- comprising 80% of the eating and drinking citations issued since late 2014. The majority of BART passengers are white and Asian -only 10% are black.

The records request was made after a protest, attended by BART Director Janice Li, drew significant attention to the longstanding issue of disproportionate enforcement of rules on BART, after a BART police officer was recently recorded citing and detaining a black passenger eating a sandwich on the platform.
