US Department of Defense Under Fire

San Francisco, New York, and Philadelphia filed a federal lawsuit alleging the US Department of Defense is breaking federal law by failing to report to the FBI when a member of the military is convicted of a crime that would prevent him or her from buying or possessing firearms.

The lawsuit comes on the heels of the mass shooting in a Texas church where 26 people were killed in November.  The shooter Devin Kelley was a former member of the Air Force and was convicted of assaulting his wife and stepson in 2012 - a crime that would have prevented him from purchasing the assault weapon used in the shooting.

The Air Force subsequently admitted it failed to report his conviction to the FBI.
